Good afternoon,
On review of building permit 22-113829-BP for the subject address, I am awaiting the details on the covered patio that were requested by building. Please be aware, the patio cover was not part of the approved development plans under SPR-DAP-ADJ20-13, and would require a Class 2 Site Plan Review prior to approval of the building permit, as a covered patio is considered an expansion of the business. Hi Justin,
I dont see the patio cover called out in the initial development reviews attached. Apologies that I missed the details on the structurals as I dont typically review those as a planner. However, when outdoor seating is proposed to be covered, it then counts towards the total square footage of the business, which then affects the parking count. In addition, any new accessory structure would trigger site plan review regardless if it would affect the parking count. The attached decisions reference only a 4,000 sq ft suite and make no apparent reference to the additional 500 sq ft patio cover, which would change the parking requirement by two spaces and would need to be evaluated through a land use decision.
I have also done the most recent decision at the Willamette Town Center (SPR-ADJ-DAP22-35) and have attached the parking count I used. It seems the proposal would still meet the parking requirement with the addition of the patio cover. I would be happy to expedite that decision for you upon receiving the application and fee. The other option would be to move forward with the building permit without the patio structure for the time being.
