I received the memo, and I think this helps to clarify pedestrian access and bicycle parking requirements. However, I am concerned with the submittal requirements which include property owner signature and deed from the apartment complex. I dont think a copy of the maintenance easement is a substitute for a property owner signature or the requirement for a copy of the recorded deed. The concern is that this land use decision includes improvements on abutting property for which we have no written consent, further, with the Class 2 Site Plan Review application, this property owner would not receive notice or chance to appeal. So we will need the deed and property owner signature to continued.
Alternatively, you could modify the scope of work to eliminate the accessway improvements on the apartment property with this first site plan review application, which would allow you to proceed with a portion of the project. This would give you time to get the signature and deed from the property owner for a second site plan review application that would cover the accessway improvements. It is a little convoluted, just trying to think of creative ways to move the project forward.
