The May 13th submittal now includes signatures from all property owners, and the Public Works Department is okay with accepting the TIA as complete.
Here are the remaining issues for Planning:
1) We can process the current application without the legal parcel validation application, however, there will be a condition that the unlawfully created unit of land will need to be addressed before any map changes take place. So if you dont want to submit this application now, we should be able to deem complete.
2) The tree conservation approval criteria in SRC 808.035(d) needs to be addressed. The last statement we have appears to address the Tree Variance criteria in 808.045, but we havent received a Tree Variance application. Lisa and I have concerns with that the number of trees proposed for removal exceeds 75 percent, and that 27 significant trees are proposed for removal. It appears that there are trees that will be in the rear yard for lots abutting Auburn and State that could be preserved, at least it hasnt been described why it is reasonably necessary to remove these trees to accommodate the development. Similarly, a large grove of trees is proposed for removal in a portion of the proposed stormwater detention area. Are there any reasonable design alternatives that could shift the detention area away from this grove, allowing for the preservation of these trees? We dont think the TCP application is complete and recommend that you update your findings and look into revising the plan to preserve more trees. If you wish to deem the application complete as is, you may do so per SRC 300.220(d)(2). However, just like with your project on Wiltsey Road, if you cant demonstrate that the tree conservation plan criteria is met, you may have conditions placed on the decision requiring the site to be redesigned to preserve more trees.
3) The revised findings for the CPC/ZC from CR to RM-II do not have findings addressing SRC 265.005(e)(1)(E), or Goal 9, both of which are critical when changing from a Commercial designation to a non-commercial designation. In addition, the CPC/ZC findings for the IP to RS do not address SRC265.005(e)(1)(E). Per SRC 265.005(e)(2), the greater the impact of the zone change, the greater the burden on the applicant to demonstrate that the criteria are satisfied. We recommend you update your findings to address these approval criteria.
The applications were received on December 14, 2018 and are set to hit the 180-day mark on June 12, 2019. Please let us know how you want to proceed prior to June 12th.
