Frequently Asked Questions
- How long will the discovery be available? COURT APPOINTED ATTORNEYS: You will receive an email that you have discovery ready to download. You have 60 days from the date of that email to download your discovery. If you do not download the documents within that time frame, they will no longer be available and you will need to contact the Legal Department to make them available again. RETAINED ATTORNEYS: You have 60 days from the date you receive the email that indicates you need to pay for discovery before it will be available to download. If you do not pay for and download the documents within that time frame, they will no longer be available and you will need to contact the Legal Department to make them available again. Please deal with your discovery in a timely manner.
- What type of discovery is accessible from JusticeWeb? This portal will provide PDF’s of documents and photos, and if size permits, video/audio files as well. If you requested either audio or video discovery and the file(s) is too large for the portal, or you asked for copies of photographs, those must be picked up at the Legal Department front counter.
- How much does discovery cost? A flat fee of $25 covers electronic documents and photographs up to 50 pages. Other fees apply for additional materials such as audio or video files, prints of photographs, certified copies, etc. Please see the Fees for Discovery for those additional costs
- When do I pay for discovery? You must pay for discovery before it can be released to you. You will receive an email with the amount owing. As soon as we receive your payment, the discovery will be uploaded to your JusticeWeb account.
- How do I pay for discovery? You may mail a check, made out to City of Salem, or pay at the front counter of the Legal Department with either cash or check. The address is 555 Liberty Street SE #225, Salem, OR 97301. The Legal Department is open Monday through Friday from 8:00 a.m. to 12:00 p.m. and 1:00 p.m. to 5:00 p.m. PLEASE NOTE - If you mail in the payment, be sure and include the case number the discovery fee represents. The easiest option is to include a copy of the notification email you received letting you know the amount owed, which also includes the case information. If you do not include the case information, we will have no way of knowing what case the payment is for, which will delay your ability to access and download the discovery.
- Do Court Appointed attorneys pay for discovery? No.
- How often will my password expire? JusticeWeb passwords will be expired every 90 days. When that happens, you will be prompted to change your password the next time you attempt to log in to JusticeWeb..
